Secretary of Education Betsy DeVos is facing a new lawsuit alleging she failed to cancel student debt for borrowers whose for-profit colleges were shut down.

In October, a federal judge ruled that an Obama-era student loan relief program should go into effect immediately. But a group of advocates in California claim that rule has yet to be implemented.

The non-profit, Housing and Economic Rights Advocates or HERA, filed a lawsuit Tuesday alleging the Department of Education has continued to collect on the loans of tens of thousands of students that should have been discharged.

The National Student Legal Defense Network said on behalf of the HERA, "The students we are trying to help have been doubly victimized – first by the for-profit colleges that deceived them, and now by the federal government that refuses to help."

The plaintiffs demand the Education Department take immediate action to inform borrowers of their debt relief possibilities.
