House panel opens door for Teamsters to organize FedEx workers

The House Transportation and Infrastructure Committee this week made it easier for unions like the International Brotherhood of Teamsters to organize FedEx employees.
By changing the jurisdiction of how some employees can be organized -- from national to local bargaining units -- the Federal Aviation Administration Reauthorization Act that now goes to the House floor takes away provisions that made it difficult for FedEx drivers to join local unions.
The same language passed the House in 2007 but was never taken up by the Senate. Some industry observers say the provision stands a better chance of surviving with Democrats in control of both Congress and the White House.
Fed Ex spokesman Maury Lane said the company is "deeply disappointed" that the committee "voted to approve anti-competitive legislation that unfairly benefits one company -- the much larger (United Parcel Service). We strongly urge the House to reject this legislation before the inherent economic damage threatened by (Thursday's) vote becomes a reality."
U.S. Rep. Steve Cohen, D-Tenn., a member of the committee from Memphis, FedEx's world headquarters, objected to the language, saying that "to subject the number one commercial carrier in this country to a strike which the Railway Labor Act is designed to protect against" would be a mistake.
Cohen did not offer an amendment stripping the bill of the labor language as has been expected. Teamsters president James P. Hoffa circulated a letter earlier in the week seeking to kill any provision Cohen might introduce, saying the bill as written "corrects an injustice in the current law."
The Teamsters have unsuccessfully attempted to organize FedEx for years. UPS, whose drivers are largely represented by the Teamsters, supports the language because it would increase FedEx expenses and make it less competitive. Thousands of FedEx's 290,000 employees would be affected and some analysts say the company's expenses would increase 30 percent as a result of unionization.
Since FedEx was founded as an airline, it has been protected by the Railway Labor Act which covers railways and airlines with national labor contracts. UPS was founded as a ground-based courier and does not enjoy the exemption.
The language in Thursday's bill, pushed by Committee Chairman James L. Oberstar, D-Minn., would clarify that employees of an "express carrier" would be under the jurisdiction of the Railway Labor Act only if they are eligible for certification under Federal Aviation Administration rules, such as those for pilots and mechanics, and are performing that type of work. The Railway Labor Act allows unions to organize employees under a national contract, not in local bargaining units.
All other carrier employees, such as truck drivers, would be under the jurisdiction of the National Labor Relations Act and, by inference, could organize into local bargaining units, under the Oberstar language.
Cohen was joined by aviation subcommittee ranking member Rep. Thomas E. Petri, R-Wisc., and the Transportation Committee's ranking member, Rep. John L. Mica, R-Fla., both of whom said the FedEx provision gave them "heartburn."
"There's always Mylanta," responded Oberstar.
The bill will now go to the House floor and is likely to pass, as it did in 2007. However, Mica informed the committee that he is hearing the Senate may not even consider the measure for up to six months.
Cohen said after the markup that a delay would be unfortunate.
"Part of it's because of this provision," he said. "If we had a more streamlined bill, it could be done much quicker."

FDX has no unions and

FDX has no unions and doesn't need one - the company has 300,000 workers that enjoy being one of the best places to work in the world noted the last 9 years in a row. Interesting enough, UPS isn't on any perfered best places to work. In addition, one would be curious why the national trends over the past 30 years reflect a decline in union membership from 40 million to now only 3,000,000. 37 million folks already know - unions are BAD business...

Ive worked at UPS and now at FDX and lifes a whole lot better without the MOB!!(union) they never did anything for me at UPS but take my money that I worked for. Also the culture sucks at UPS and they hire managers that have absolutely no business managing also the union promotes stupid, lazy, and unproductive employees that only move up the bar because of seniority not because they are productive!!

I too work for Fedex and if you want to talk about bad managers or unfair promotions or no promotions at all I can tell you some things that I'm sure you have seen as well.
Dont know what your big beef is but had the money that was spent on keeping the union out had been spent on the PEOPLE of the PURPLE PROMISE Im sure there would not be a problem but greed feed by the lack of raises and 401K contributions and taking away the pension who could blame the people. They have families to feed but FedEx doesnt care just like you I got my TEAM PLAYER letter but if we are all team players why is my team not getting big bonus checks does anyone care that my children have to do with out while FEDEX is spending Millions try ing to stop the union from comming to their home team?

The money the union took from you wages to pay for your insurance and pension if you do the math your insurance for a family at FEDEX will cost you more that union dues and cover less with a lot more hassle.

Okay unions may be bad in some respects but I am certain that if UPS was not organized by the teamsters their employees would have lower wages, less health care, if any and less job security. Those things are some what important don't ya think? Also in my experience UPS drivers are more courteous, more professional and much more customer focused than Fed Ex.

Railway Act

I would agree in part with your response in regards to Unions but you are totally of base in terms of UPS as a prefered employer. Our wages are higher than yours. The benefits offered to our employees including our part-time employees are unparalleled in the industry.

I say that FedEx is finally getting their just desserts and I hope this legislation passes because finally it will level the playing field in terms of labor relations. FedEx has unfairly enjoyed protection under the Railway Act. If FedEx went on strike tomorrow we could handle their 7 million packages without any problem. I say its time for FedEx workers to organize! Either that or level the playing field in another way and allow UPS to enjoy the protection FedEx enjoys under the Railway Act.

I work for Federal Express. Last year we got less then $50 dollars a person in profit sharing. We don't have matching contributions to our 401K anymore. Our health benefits get more and more expensive every year. Not to mention they froze our wages. And if you transfer from state to state they drop your pay. Plus the amount of work for the pay is horrible. When I finish my degree I will be looking for another job. It is a horrible place to work. Mindless drones that is how your treated. If your intelligent enough to voice an opinion, it will be shot down.

I agree!!! I love working for Fedex. My company treats me and my coworkers fairly. I have great ins coverage, that I would not be able to get at the cost I am getting now anywhere else. I could go on forever on the wonderful things about it. I do not see how a union would do ANY GOOD whatsoever for this company. I do not need nor want to pay dues for someone to speak for me. I can do that on my own. When I need to speak, I have always had someone listening and letting me know my voice has been heard. There are laws in place and OSHA. Unions are money hungry, that is all. They want Fedex because all of the other companies that they have gotten their grubby little fingers on have gone under. So now their wallets are suffering. Oh poor them. Maybe instead of harassing people, all of the teamsters should find some real jobs, instead of making excuses of why we need a union. This isn't the 1900s. Unions need to be phased out.

You obviously don't work for the same fedex as I do if you say you can't get cheaper insurance anywhere else.We pay anywhere from $200 to $250 a month plus a co-pay.As we keep reminding people like you, our main competitor (ups) pays $0 and has no co-pay.Now if ups pays $0 and fedex pays $250 what does common sense tell you? Unions are dinosaurs

Unions are dinosaurs, and need to come to an end just like the dinosaurs. They were great when they were needed, but we now have tons of employee laws, OSHA and a lot of government agencies that look out for employees. Look what unions have done for us lately: Airlines going under, the current auto manufacturing crisis, and more. The US can’t be competitive with foreign countries because it has unnecessary labor costs.

Unions are also a drain on the regular tax payers. A lot of union people work for a short time, then when their contract ends go on unemployment until their number comes back up in the union hall. Who is paying for all that unemployment insurance? The hard working taxpayers that’s who.

FedEx doesn’t need a union. The union needs FedEx for more revenues to continue to make money off the backs of hard working people and companies. Speaking of UPS, look at their last strike. They were out for a while and probably lost more while they were out than they made with the company concessions.

Unions are also defaulting on their retirement promises to past members. It’s time for these parasites to earn a living on their own.

I am a UPS driver

I do not feel like I am better than a Fed Ex driver. What I do feel is sorry that Fed Ex drivers are not paid as well or have the same health care or pension benefits. These drivers work very hard and are not compensated for it. I don't know but do Fed Ex employees have a pension? A Fed Ex driver has hardly any recourse if he is fired for a bogus reason. At least I feel I have some representation.

There was a comment about courtesy. The perception is we we are not. In reality is we are extremely busy and must do so many stops per hour or we have a supervisor telling us we need to move faster. Some drivers do not handle this type of stress well. I am a very patient person but if you are holding me up for a small insignificant reason I'm going to let you know. Now I do know there are some bad apples out there that should not be driving (yes, the union does protect them as well) but the majority of us are courteous.

This is pretty funny stuff. AT Fedex, our pension is 2 to 1 they put in for us, we top out only a dollar less an hour than UPS drivers but have to work no were near as hard. We don't go on strike so we don't miss any pay. We also don't pay any dues to the useless mafia who can't even say they will take wage cuts in this economy in the auto sector cause they don't want to lose those dues but would rather put regular joes out of work. Whether you are part of the mafia or not, if someone wants to fire you they can , so your false sense of security is a laugh as I was part of a union.
Our benefits are also better, this is because we are not unionized which keeps FedEx's expenses down which allows them to put in more for us. SO, this all being said, we don't want the mafia in our place....Peace!

Actually FedEx Express

Actually FedEx Express drivers do top out a dollar less than UPS air drivers. Thats the same job. You can not compare a Express driver to a UPS driver that does air and ground.. The ones who do closer to what a UPS driver does is your ground drivers and they get a unfair wage and no benefits

Fedex pay is nowhere close to UPS

I've been a courier at fedex express for 6 years and I make 15.29 per hour.Top pay is around $20 per hour.The UPS driver beside me makes $29 per hour and pays nothing for health care and pays $75 per month for union dues. Those union dues are a small price to pay for that kind of money and benefits. there's really no comparison and anyone who says so is either management or just flat out stupid.

those ups guys get free medical a way bigger pension than you will every see the plus money from the union after a certain amount of years in the union as for those dues you would be paying that’s to get you that contract for all that money you will be getting, and last I heard by the end of UPS new contract the drivers will top out at $36 hour they get raises ,REAL RAISE a set dollar amount ever year and who told you that "your benefits are also better", next time you at a pick up and there is a ups driver there doing the same thing ask him how much does he pay for health care he will say nothing then ask him what is his co pay, he will say nothing, check your facts………………………
